Your reply of acceptance via email, text message, written or telephony agreeing to The Design Affiliates terms and conditions is as follows.

Terms of Sale: No work will proceed until payment is received (half payment minimum), including shipping and handling is required with order. Payment is due in full pon completion of each project. After that time, you will be charged an additional 10% of the total price as agreed from the approved quoted price for each additional 7 day period there after commencing on day 6 if payment has not been received in full. No refunds once your order has been verified and started. No partial refunds for work not completed. See (Changing files that have been sent to press or production) In the event of litigation the parties agree that such action will be brought in the county of Riverside. If an action is commenced to enforce payment, buyer agrees to pay seller's attorney's fees, court costs and other costs of collection.

Refund Policy: All sales are final. No refunds are available on orders unless work has not been started and the refund is requested the same business day. In the case of a refund on an order that work has not started, a $15 processing fee will be charged. Refunds may take up to 21 business days to be issued.

You are 100% responsible for your digital file(s): If your files are not submitted properly The Design Affiliates cannot be held responsible. We will not double check your files and equally are not responsible for errors or misspellings or your original artwork! Please be sure to proofread your document very carefully and inspect your file preview. If your digital files do not meet the exact dimensions necessary for printing with Bleed and Safety, the preview will resize your files automatically, potentially distorting your files. Should your files become distorted, you take full responsibility for re-submitting your files with proper Bleed and Safety zones.

Color Accuracy: The Design Affiliates will reproduce color from submitted images, photos, or digital layouts as closely as possible, but cannot exactly match color and density (as viewed in a 5000K light booth) because of limitations in the printing process, as well as neighboring image ink requirements. The accuracy of each color reproduction is guaranteed to be within 85-90% of the original image you submitted. We accept no responsibility for color variations between submitted images and the actual artwork or product they represent.

Indemnification: The customer will indemnify and hold harmless the printer, The Design Affiliates and its subsidiaries, from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions and proceedings that may be instituted against the producer on the grounds alleging that said production firm violates any copyright or any proprietary right of any person as a direct result of your project.

Delivery: Quoted turnaround times start when we verify your order, provided we have the photos and artwork needed to complete your job, not from when the order is first submitted. Turnaround times vary between 5-7 business days

(PRINTING), 30 days + 1 week cushion (WEB PRODUCTION), 4-8 weeks (VIDEO) and are not guaranteed unless a RUSH order is selected. Any project delivery time of less than the before mentioned is considered a RUSH project and will be charged accordingly.

Turnaround: Jobs submitted by 4:00 PM PST (Pacific Standard Time) (PRINT) that meet our digital file guidelines and include full payment will be submitted by the next business day. Business days are Monday to Friday and do not include weekends or holidays. Orders submitted on Saturday, Sunday or holidays will begin on the next business day. The Design Affiliates is not responsible for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Orders may not be ready on time due to unforeseen circumstances such as breakdown of equipment, power outages etc. therefore turnaround times are not guaranteed.

Copyright: Customer agrees that all designs, edits, tapings, sound, video, art, illustration and/or any and all
production produced by The Design Affiliates and its subsidiaries are the sole property of its respective producer (The Design Affiliates) and can at anytime be used for advertisement, commercial, promotional use or any use deemed necessary buy The Design Affiliates without any prior written and/or verbal agreement by the buyer or originator of purchase. Any reproduction of these works without written permission of the original owner as mentioned above is considered a violation of this agreement and enforceable by US copyright laws. (www.copyright.gov). Reprinting, multi-copies, recopies, duplications are considered outside of its original purpose. License for additional use and/or exclusive ownership can be purchased by contacting the owner as mentioned above.

Changing files that have been sent to press or production: As a courtesy to our customers, The Design Affiliates allows replacement of files sent to press but not yet started depending on the job status: Once we have checked your file and it is ready for press or editing (production) we cannot accept replacement files beyond this point.

Complaints: All complaints must be registered within 24 hours of receipt of job. Should the job contain manufacturing errors and/or defects, we would reproduce at no charge. We maintain the right to judge what a manufacturing defect and error is.

Sales Tax: All California orders are subject to sales tax. If customer is tax exempt, exemption certificate must be sent or faxed to us with the first order. Material and Samples: All materials we create in producing your job are the property of The Design Affiliates. These materials will not be sold or given to any other party. We reserve the right to distribute free samples of your printed piece and use your artwork in our advertising.

 Hosting for (12) months. The customer information on this order will be used as the registrant and contact information for these domains and will be listed in the public whois directory. Any additional changes outside of this agreement will be subject to additional charges. Any changes and or updates will incur and additional charge(s) based on current hourly rates as stated by The Design Affiliates. Any broken links or links to your site are not the responsibility after the first (14) days of project completion.

PAYMENT:
Full payment, including shipping and handling (if applicable) is required with each order with the exception only to web development in which a non refundable 50% deposit is required prior to initiation of project development for incidentals and non refundable purchases on the customer s behalf. No work will proceed until payment is received. No refunds once your order has been verified and accepted via written confirmation (including all email responses). No partial refunds for work not completed. In the event of litigation the parties agree that such action will be brought in the county of Los Angeles. If an action is commenced to enforce payment, buyer agrees to pay seller's attorney's fees, court costs and other costs of collection.

Due to the nature of all production processes you may receive +/- 10% variance in any and or all of your final product except where premium services are utilized.
